Q: What is the Maine law forbidding sexual harassment?

?Sexual harassment is prohibited by Section 4572 of the Maine Human Rights Act.?

Q: What is the State of Maine's definition of Sexual Harassment?

Unwelcome sexual harassment is a form of sex discrimination that violates the Maine Human Rights Act. Unwanted sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature which threatens job security, working conditions, or advancement opportunities is considered sexual harassment.

Harassment includes:

  • Unwelcome Sexual Advances
  • Suggestive or Lewd Remarks
  • Unwanted Hugs, Touches, Kisses
  • Requests for Sexual Favors
  • Retaliation for Complaining About Sexual Harassment

Q: What is Maine's policy on Retaliation?

It is a violation of the law for an employer to take action against you because you oppose or speak out against sexual harassment in the workplace. The Maine Human Rights Act prohibits employers from retaliating or discriminating against any person because that person opposed an unlawful discriminatory practice. Retaliation can occur through direct actions, such as demotions or terminations, or more subtle behavior, such as an increased workload or being transferred to a less desirable location. Maine Human Rights Act protects individuals against retaliation who have a good faith belief that their employer's conduct is illegal, even if it turns out that they were mistaken.

Q: What are the Maine requirements for a Sexual Harassment Prevention Policy?

?All employers must post in a "prominent and accessible" location in the workplace information regarding the illegality of sexual harassment. The poster must include, at a minimum, information regarding (1) the illegality of sexual harassment on the job; (2) a description, including examples, of sexual harassment; (3) the complaint process available to a victim through the Maine Human Rights Commission; and (4) information regarding how to contact the Maine Human Rights Commission. The poster cannot exceed basic sixth grade literacy standards in order to be accessible to all workers. Employers may design their own posters, in accordance with the standards listed above, or may obtain a poster through the Maine Human Rights Commission?

Q: What are the minimum standards for a Sexual Harassment Prevention policy in Maine?

The minimum Sexual Harassment Prevention policy should:

  • Prohibit sexual harassment
  • Provide examples of prohibited conduct that would constitute unlawful sexual harassment
  • Include information concerning the federal and state statutory provisions concerning sexual harassment, remedies available to victims of sexual harassment, and a statement that there may be applicable local laws
  • Include a complaint form
  • Include a procedure for the timely and confidential investigation of complaints that ensures due process for all parties
  • Inform employees of their rights to be compensated or set a situation right
  • All available forums for reporting for sexual harassment complaints administratively and judicially
  • Clearly state that sexual harassment is considered a form of employee misconduct and that sanctions will be enforced against individuals engaging in sexual harassment and against supervisory and managerial personnel who knowingly allow such behavior to continue
  • Clearly state that retaliation against individuals who complain of sexual harassment or who testify or assist in any investigation or proceeding involving sexual harassment is unlawful

Q: Where can sexual harassment occur in Maine?

Unlawful sexual harassment is not limited to the physical workplace itself. It can occur while employees are traveling for business or at employer-sponsored events or parties. Calls, texts, emails, and social media usage by employees can constitute unlawful workplace harassment, even if they occur away from the workplace premises, on personal devices or during non-work hours.

Q: What is considered a protected activity under Maine law?

"Protected Activity" is when an employee does one of the following:

  • Files a formal written complaint of sexual harassment, either internally with management or an HR department, or externally with an anti-discrimination agency
  • Testifies in court or assist in an investigation involving sexual harassment
  • Opposes sexual harassment by making a verbal or informal complaint to management, or by simply informing a supervisor or manager that harassment occurred
  • Complains that another employee has been sexually harassed
  • Encouraged a fellow employee to report harassment

Employees who have engaged in protected activities are legally protected from retaliation.
