The California Fair Employment and Housing Act (FEHA) establishes certain employment practices as unlawful, including direct or indirect harassment of an employee by the employer or its agents with the employer's knowledge.

What is SB 1343 under the Fair Employment and Housing Act?

California Senate Bill 1343 (SB 1343) is an amendment to Sections 12950 and 12950.1 of the Government Code, specifically addressing workplace harassment and discrimination in employment. Enacted in 2018, SB 1343 modified sexual harassment prevention training requirements for California employers.

Key Changes Introduced by SB 1343:

  • Training Requirements: SB 1343 mandates that California employers with five or more employees, including temporary and seasonal staff, provide at least two hours of sexual harassment prevention training to supervisory employees and at least one hour to nonsupervisory employees.
  • Deadline for Compliance: As of January 1, 2021, all employees must have completed the required training. Employers who had provided training after January 1, 2019, were granted an extension to meet the January 1, 2021 deadline.
  • Modification of AB 1825 Rules: SB 1343 updates the rules established by the previous California AB 1825 sexual harassment training requirements, which applied to employers with fifty or more employees. The new law extends training obligations to smaller employers.
  • Expanding on AB 2053: Building on AB 2053, added in 2014, SB 1343 includes non-supervisory employees in the training requirement. It covers one hour of sexual harassment education and training within six months of hire and every two years thereafter.
  • Definition of Abusive Conduct: SB 1343 defines abusive conduct, as introduced by AB 2053, encompassing verbal abuse, derogatory marks, insults, and hostile or offensive verbal and physical conduct.
  • Temporary Employee Inclusion: SB 1343 extends training requirements to temporary employees. Employers must provide sexual harassment training within 30 calendar days of hire or within the first 100 hours worked, whichever comes first.
  • Compliance Monitoring: The California Department of Fair Employment and Housing (DFEH) oversees compliance with these regulations. Employers are urged to ensure adherence to these requirements to foster a harassment-free workplace.
