AB 2338: Talent Agencies and Educational Responsibilities

In the pursuit of a safer and respectful environment within the entertainment industry, AB 2338 sets forth explicit requirements for talent agencies operating in California. These agencies are mandated to equip their adult artists with educational materials covering sexual harassment prevention, retaliation, reporting resources, as well as information on nutrition and eating disorders.

Key Components of Educational Materials:

  • Materials must meet the specifications outlined in the Civil Rights Department form, CRD Form 185, for sexual harassment prevention, retaliation, and reporting resources.
  • For nutrition and eating disorders, the materials must incorporate components specified on the National Institute of Health’s Eating Disorders webpage.

Enforcement and Consequences:

  • Labor Code section 1700.54 establishes violations for failing to provide educational materials or making them available in a language understood by the artist.
  • Failure to request and retain a minor's entertainment work permit is also considered a violation.
  • The Labor Commissioner has the authority to inspect and investigate compliance, with enforcement initiated from June 30, 2019.

Additional Obligations for Talent Agencies:

  • Talent agencies must request and retain a copy of a minor’s entertainment work permit before representing or sending the minor artist on any auditions, meetings, or interviews.
  • Agencies with five or more employees are obligated to provide Sexual Harassment Prevention Training to both supervisory and nonsupervisory employees.

AB 3175: Requirements for Entertainment Work Permit Applicants (Ages 14-17)

In response to the urgency outlined in AB 3175, immediate action is required for entertainment work permit applicants aged 14-17. This legislation mandates completion of sexual harassment prevention training, retaliation awareness, and reporting resources through an online course provided by the Civil Rights Department (CRD) before obtaining an entertainment work permit.

Key Requirements:

  • Parental or legal guardian involvement is crucial during the training, emphasizing the importance of understanding the content.
  • A certification by the parent or legal guardian confirming the completion of the training is mandatory.
  • Applicants must furnish satisfactory proof of training completion in the form of a certificate from the CRD's internet website to the Labor Commissioner.
  • Training, conducted in a language understood by the participant, must be repeated every two years from the most recent completion date.

Options for 13-Year-Old Minors Turning 14:

  • Apply for a permit expiring on the minor’s 14th birthday.
