The federal agency alleges persistent sexual harassment of female employees by three managers, coupled with retaliation against those who reported the misconduct.

Allegations of Blatant Harassment and Retaliation:

The EEOC contends that the managers at South Austin Nissan engaged in inappropriate and persistent sexual harassment. Their actions ranged from unwanted physical contact to explicit comments about the appearance and personal relationships of female employees. Shockingly, the managers encouraged female sales staff to adopt a provocative dress code, implying that revealing attire would enhance their sales performance.

The hostile work environment extended to discussions of explicit sexual encounters and the viewing of inappropriate content. The managers' conduct compelled Several female employees to leave their jobs. Despite reports to the NICPA Central Auto Group's human resources leader and chief operating officer, the EEOC asserts that no proper investigation or corrective action was taken. Instead, reporting employees were transferred to other dealerships managed by NICPA, with one manager facing a reduction in pay and subsequent termination.

Violation of Title VII and Legal Action:

The alleged conduct at South Austin Nissan is in unrestrained violation of Title VII of the Civil Rights Act of 1964, which bans sexual harassment in the workplace. In response, the EEOC has initiated a lawsuit (Civil Action No. 1:23-cv-01541) seeking back pay damages, compensatory and retributive damages, and injunctive remedies. The latter includes calls for enhanced oversight of investigations into sexual harassment and discrimination.
