What is Sex-Based Discrimination?
Sex-based discrimination is a type of discrimination that involves treating someone unfavorably because of their sex.
This can include discrimination based on gender, sexual orientation, gender identity, or pregnancy.
Sex-based discrimination is a violation of Title VII of the Civil Rights Act of 1964, which prohibits discrimination in employment on the basis of sex, among other protected characteristics.
This means that it is illegal for employers to discriminate against employees or job applicants on the basis of their sex, including by paying them less, denying them promotions, or subjecting them to harassment or a hostile work environment because of their sex.
Sex-based discrimination can take many forms, including (but not limited to):
- Refusing to hire or promote someone because of their sex
- Paying an employee less than others doing the same job because of their sex
- Creating a hostile work environment based on sex, such as making derogatory comments or displaying sexually explicit materials
- Retaliating against an employee who complains about sex-based discrimination or harassment
It is important for employers to take proactive steps to prevent and address sex-based discrimination in the workplace, including implementing policies and procedures that promote a respectful and inclusive work environment, providing training to employees and managers on preventing discrimination and harassment, and promptly investigating and addressing any complaints of discrimination or harassment that are reported.
